Terms of Use

These Terms of Use (the "Terms") govern your access to and use of the platform operated by Tifólio Tecnologia("Tifólio", "we", "us"), a company organized under the laws of Brazil, registered under CNPJ 35.014.292/0001-04, with offices at Rua José Izidoro Biazzetto, 1210 — Curitiba, PR, Brasil.
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who may use the Service
You must be at least 13 years old to use Tifólio, and at least 18 to purchase a subscription. If you use the Service on behalf of a company, you represent that you have authority to bind that company to these Terms.
You are responsible for your account credentials and for everything that happens under your account. Tell us at contato@tifolio.com.br if you believe someone else has gained access to it.
2. Your content stays yours
You own everything you create on Tifólio — your projects, presentations, forms, contracts, boards, and the files you upload. We claim no ownership of it.
You grant us a limited license to host, store, reproduce, and display your content only as needed to operate the Service and to do what you ask us to do: publish a presentation at a link, email a contract for signature, show your public profile. This license ends when you delete the content, except for copies we must retain as described in our Privacy Policy.
We do not use your content to train machine learning models.
You are responsible for having the rights to what you upload, and for what you collect from your own clients through forms, presentations, and contracts. When you use Tifólio to gather information from your clients, you are the one deciding what to ask; we store it on your behalf.
3. Practice briefs and fictional clients
Tifólio provides briefs with fictional clients so you can build a portfolio without waiting for a first commission. The briefs are ours, and are licensed to you for your own practice and portfolio use, including commercial promotion of your services.
What you make in response to a brief is yours. You may not resell or redistribute the briefs themselves as your own product.
4. Acceptable use
You agree not to:
- break the law, or infringe anyone's rights;
- upload malware, or attempt to gain unauthorized access to the Service, to other accounts, or to our infrastructure;
- harass, impersonate, or post content that is hateful, threatening, or sexually exploitative;
- scrape or bulk-collect data from the Service, or resell access to it;
- use the Service to send unsolicited bulk email, or to collect information from people under false pretenses.
We may remove content or suspend accounts that violate these Terms. Where it is reasonable to do so, we will tell you why.
5. Plans, billing, and cancellation
Tifólio offers a free plan and a paid PRO plan, billed monthly or annually. Prices are shown before you purchase.
Billing is currently processed in Brazilian reais (BRL). If you pay with a card issued outside Brazil, your bank sets the exchange rate and may add an international transaction fee that we neither control nor receive.
Paid plans renew automatically until you cancel. You can cancel at any time from Settings, with no penalty; your PRO access continues through the end of the period you have already paid for. Cancelling does not delete your account — it returns to the free plan, and your profile and work remain.
You have 14 days to change your mind on your first payment. Our Refund Policy sets out that guarantee, what happens to unused time when you cancel, and how to ask.
We may change prices. Existing subscribers will be notified before a price change takes effect on their plan.
6. Electronic signatures
Tifólio's signing feature lets you and the people you invite sign documents electronically. When a document is sent, its contents are locked with a verification hash, and each signature is recorded with the date, time, IP address, and browser.
The parties intend those signatures to be legally binding under the federal ESIGN Act and applicable state UETA. You are responsible for the contents of the documents you create and send.
The document templates we provide are a starting point, not legal advice. Tifólio is not a law firm. For high-value work or unusual situations, have a lawyer review your contract.
7. Availability and changes
We work to keep the Service available, but we do not promise it will be uninterrupted or error-free. We may modify, suspend, or discontinue features. If we discontinue the Service entirely, we will give you reasonable notice and a way to export your content.
8. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, TIFÓLIO DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, THAT IT WILL BE UNINTERRUPTED OR SECURE, OR THAT ANY DEFECT WILL BE CORRECTED.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TIFÓLIO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.
TIFÓLIO'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS.
Some jurisdictions do not allow the limitation of certain damages, so parts of this section may not apply to you.
10. Indemnification
You agree to indemnify and hold harmless Tifólio and its officers, employees, and agents from any claim, damage, or expense (including reasonable attorneys' fees) arising out of your content, your use of the Service, your violation of these Terms, or your violation of the rights of any third party — including claims brought by your own clients relating to documents or forms you created with the Service.
11. Termination
You may stop using the Service and delete your account at any time from Settings. We may suspend or terminate your account if you materially breach these Terms, or if we are required to by law.
Sections 2, 8, 9, 10, and 12 survive termination.
12. Governing law and disputes
These Terms are governed by the laws of Brazil, and the courts of Curitiba, Paraná, Brazil are the agreed forum for disputes arising from them.
This does not deprive you of the protection of the mandatory consumer laws of the state where you live. If you are a consumer in the United States, you keep any rights and remedies that your state's law does not allow to be waived by agreement, and you may be able to bring a claim in your local courts.
13. Changes to these Terms
We may update these Terms. When the change is material, we will notify you by email or in the Service before it takes effect, and ask you to accept the new version. The date at the top always reflects the current version.
